A BILL TO BE ENTITLED AN ACT TO AMEND THE EXTRATERRITORIAL JURISDICTION AUTHORITY OF THE TOWN OF WEAVERVILLE, TO MAKE A SIMILAR TECHNICAL CORRECTION AS TO THE CITY OF ASHEVILLE, TO ALLOW THE COUNTY OF BUNCOMBE TO ZONE CERTAIN DONUT HOLES, TO REPEAL THE BUNCOMBE COUNTY CULTURE AND RECREATION AUTHORITY, AND TO ALLOW THE BOARD OF COMMISSIONERS OF HENDERSON COUNTY TO STANDARDIZE THE CEILING ON FIRE DISTRICT TAXES IN HENDERSON COUNTY. Enacted June 24, 2014. Section 1 is effective July 1, 2014. Section 2 is effective on and after April 17, 2013. Section 4 is effective June 30, 2014. The remainder is effective June 24, 2014.

Senate committee substitute makes the following changes to the 5th edition:
Changes the short and long title.
Repeals SL 2013-262, which established the Buncombe Culture and Recreation Authority. Effective June 30, 2014.
Amends GS 69-25.1, as it applies only to Henderson County, to provide that the Henderson County Board of Commissioners can enact by ordinance, in an area that has previously been established as a fire protection district and in which there has been authorized by a vote of the people a special tax not exceeding 10 cents for every $100 of real property owned, an increase in the maximum allowable special tax to the maximum of 15 cents for every $100 of real property owned (previously, there were petition and election requirements in order to increase the fire protection tax, now deleted). Makes conforming changes to GS 69-25.4.
Changes the effective date of Section 1 of the act, concerning the Town of Weaverville, from November 1, 2013, to July 1, 2014.

Amends GS 160A-360 (territorial jurisdiction) to provide that the Town of Weaverville has no authority to exercise any power under the statute. Provides that upon relinquishment of the jurisdiction over an area that the Town is regulating under GS Chapter 160A, Article 19 (planning and regulation of development), the regulations and powers of enforcement remain in effect until the sooner of the following: (1) Buncombe County has adopted the regulation, or (2) a period of 120 days has elapsed following the effective date of the act. Gives Buncombe County the authority to continue to appoint residents residing within one mile of the Weaverville municipal limits, as if GS 160A-362 applied. Applies to Weaverville only. Effective July 1, 2013.
