    AN ACT AMENDING MOTOR VEHICLE LAWS REGULATING MODIFIED UTILITY VEHICLES AND DIRECTING THE USE OF CERTAIN FUNDS APPROPRIATED TO THE DEPARTMENT OF TRANSPORTATION. SL 2021-33. Enacted June 14, 2021. Sections 1, 2, and 2.3 are effective October 1, 2021. The remainder is effective June 14, 2021.

    Conference report makes the following changes to the 5th edition.

    Deletes proposed GS 20-53.6, permitting an owner of an all-terrain vehicle or a utility vehicle to apply to the Division of Motor Vehicles (DMV) for a certificate of title upon submitting an application with specified content and paying the $52 application fee. Deletes the conforming changes to GS 20-54.

    Amends GS 20-286(10), excluding modified utility vehicles from the definition of motor vehicle, as the term is used in Article 12, Motor Vehicle Dealers and Manufacturers Licensing Law.

    Revises the directive set forth in Section 3, now requiring the Department of Transportation (DOT), Ferry Division, to lease a passenger ferry for operation between Hatteras and Ocracoke for a term to end by August 15, 2021 (was, September 12, 2021), and requiring DOT to use $700,000 (was, $943,000) of the funds appropriated from the Highway Fund to DOT in SL 2020-91 (DOT 2020-21 FY Budget/Governance) to lease and operate the ferry. Adds new requirements for the Ferry Division to exercise the opt-out clause of the lease when it determines the State-owned ferry for passenger service on the identified route can be operationalized within 30 days if the cost of opting out is less than the cost of completing the lease term. Requires any remaining funds at the lease's expiration or termination to be deposited in the Ferry Statewide reserve account in accordance with State law.

    Enacts GS 20-53.6 permitting an owner of an all-terrain vehicle or a utility vehicle to apply to the Division of Motor Vehicles (DMV) for a certificate of title upon submitting an application with specified content and paying the $52 application fee set forth in GS 20-85(a)(1). Makes conforming changes to GS 20-54, which previously required the DMV to refuse registration or issuance of certificates of title or any transfer of registration of utility vehicles, to now permit issuance of a certificate of title as provided in new GS 20-53.6. Effective October 1, 2021.

    Revises the proposed changes to the definition of modified utility vehicle in GS 20-4.01, which is a cognate of passenger vehicle in GS Chapter 20, to include a motor vehicle that is uplifted by a licensed manufacturer, dealer, or person or business otherwise engaged in vehicle manufacturing or modification (was, a motor vehicle that is "custom-built"), as an alternative to a vehicle that is manufactured, for off-road use with equipment and specifications as described. 

    Adds a new directive to require the Department of Transportation (DOT) to lease a passenger ferry for operation between Hatteras and Ocracoke for a term to end by September 12, 2021. Requires DOT to use $943,000 of the funds appropriated from the Highway Fund to DOT in SL 2020-91 (DOT 2020-21 FY Budget/Governance) to lease and operate the ferry. Effective on the date the act becomes law.

Makes technical changes.

    Amends the definition of modified utility vehicle in GS 20-4.01, which is a cognate of passenger vehicle in GS Chapter 20, to no longer require an engine displacement greater than 2,400 cubic centimeters and to require an overall length of 110 inches or greater rather than 142 inches or greater.

    Amends GS 20-121.1 to explicitly prohibit modified utility vehicles from operating on any street or highway having four or more lanes regardless of the posted speed limit. Separates the required equipment of a modified utility vehicle from that of mini-trucks and low-speed vehicles. No longer requires modified utility vehicles to have a windshield or windshield wipers. Adds a new provision to require the operator and all passengers of a modified utility vehicle to wear safety helmets with a retention strap compliant with federal standards if the vehicle is not equipped with a windshield and windshield wipers. Adds a new qualification to the Department of Transportation's statutory authority to prohibit the operation of low-speed vehicles, mini-trucks, or modified utility vehicles on any road or highway if it determines that the prohibition is necessary in the interest of safety, to provide that the authority is granted notwithstanding the provisions of any other subdivision of the statute. 

    Effective October 1, 2021.
